Protection against disability discrimination is available to those who meet the definition of "disabled" under the ADA. This can be a catch-22, because in order to qualify a person must be not too disabled but disabled enough. Under the ADA, a person is considered disabled if a physical or mental impairment significantly limits him or her from "major life activities," including walking, talking, seeing or hearing. Also, a person may be considered disabled under the ADA if he or she is unable to perform a broad range of jobs due to the disability.

All employers with 15 or more employees for a minimum of 20 weeks are required by ADA to make "reasonable accommodation" to accommodate an employee with a physical disability. These may include:

  • Installing special equipment such as a wheelchair access ramp, large computer monitor, Braille display terminal, and large or illuminated keypad
  • Modifying the work schedule
  • Allowing an employee to use vacation or take unpaid leave for medical reasons

Under ADA, employers covered by the law may not discriminate against otherwise qualified individuals in:

  • Other conditions of employment
